Maxim has extensive experience in dispute resolution and international arbitration including participation in arbitration proceedings subject to the Rules of various institutions, including LCIA, SCC, ICC, SIAC, HKIAC, CAS, ICAC etc., and international investment disputes under the UNCITRAL Arbitration Rules, and ICSID Arbitration Rules. He is also experienced in advising on a wide range of disputes as well as proceedings to recognize and enforce foreign judgments and arbitral awards in the Russian Federation and Russian judgments abroad.

Projects

Qualification

Representing the Russian Federation in a USD 1 billion tax dispute arbitration proceedings administered under UNCTIRAL Rules.

The dispute was initiated by ExxonMobil against the Russian Federation and the Sakhalin Region under a production sharing agreement.
Investment Arbitration and Investment Disputes

Representing a client in an international investment dispute against a sovereign state governed by the Rules of ICSID AF.

Representing a Russian investor in a dispute over expropriation of metallurgical assets worth USD 500 million located in an Eastern European state.

Representing a major Asian construction company in an ICC arbitration arising out of the construction of a large energy complex.

Representing a shareholder of a Russian agricultural producer in a corporate dispute administered under the SCC Rules, as well as before the courts in Cyprus and Russia.

The case also involved conclusion of an amicable settlement agreement.

International Commercial Arbitration

Representing a UAE investor in a dispute over JV with a Russian construction group in Russian courts and parallel LCIA arbitration.

Representing a Cypriot company in a multijurisdictional corporate dispute with BVI companies arising out of a joint venture agreement.

The dispute involved multiple jurisdictions, including Switzerland, Cyprus, and Russia, as well as arbitration proceedings administered under the LCIA Rules.

Representing a Russian nuclear company in a dispute with an energy company from CIS related to a supply contract in international arbitration proceeding under ICC Rules.

Representing a nationalized Irish bank in Russian bankruptcy proceedings, corporate disputes, real estate disputes and parallel litigations and arbitrations in Ukraine, Ireland, Panama, and Belize.

Representing asset management companies of a private pension fund in the Russian courts in disputes with the Central Bank of Russia and state-owned Russian banks.

The dispute was related to challenges of transactions carried out as part of bank CVA procedures as well as in the process of amicable settlement negotiations.
Domestic Litigation

Representing Saint Petersburg in parallel disputes related to annulment of the award and enforcement of international awards of the Arbitrazh court of Moscow and the Arbitrazh court of Saint Petersburg and the Leningrad Oblast.

Prior to DGP, Maxim was an associate with the Litigation & Arbitration practice of one of the largest Russian law firms.

Maxim is a co-author of numerous articles on international arbitration published in Russian and foreign media. Maxim has written several articles as part of the HSE Academic Fund grant programme and is an author of a number of publications on business law and law of procedure. Maxim is actively involved in industry-specific events held by business and professional associations and often speaks at thematic conferences. Maxim is a member of the young lawyers group of the Hong Kong International Arbitration Centre (HKIAC45), the Singapore International Arbitration Centre (YSIAC), the Korean Commercial Arbitration Centre (KCAB «Next»), the International Centre for Settlement of Investment Disputes (ICSID-YG), the young practitioners group under the auspices of Asian International Arbitration Centre (AIAC-YPG), the German Arbitration Institute (DIS40), the Swiss Arbitration Association (ASA40), the ICC Young Arbitrators Forum (ICC-YAF), the networking group for arbitration of the International Centre for Dispute Resolution (ICDR Young & International).
