Dmitry specializes in complex cross-border disputes relating to international commercial and investment arbitration, as well as proceedings before international courts. Dmitry has acted in arbitrations under the of the SIAC, SCC, VIAC, ICC Rules as well as under the International Centre for Settlement of Investment Disputes (ICSID) Rules. Dmitry also has substantial experience in advising on insolvency matters, including cross-border bankruptcy procedures.

Projects

Qualification

Representing a Belarusian contractor in an SCC arbitration against a Central Asian state and a state concern. The dispute relates to the construction of an ore fertiliser plant in Turkmenistan under a US$1 billion contract.

Representing a PSG-International and Prefa a.s., two Czech construction companies, who both acted as main suppliers at different stages in the large construction project in Russia, in disputes against the bankrupt buyer and subcontractor as well as the guarantor bank.

This engagement included representation of the clients in several court proceedings in Russia as well as in parallel ICC arbitration.
International Commercial Arbitration

Representing a Russian state-owned entity in SCC and VIAC proceedings in two construction disputes arising out of contracts for supply of building modules.

Representing a Russian manufacturer of construction materials in a dispute before the International Commercial Arbitration Court for the Russian Chamber of Commerce arising out of the supply of defective lime-sand brick press by a German manufacturer.

Also representation in subsequent enforcement of the arbitral award in Germany.
International Commercial Arbitration

Representing Dekhkanabad Potash Plant, one of the leading fertilizer producers in Central Asia, in a number of cross-border disputes with its Russian contractor (undergoing bankruptcy), in connection with the construction of a potash plant in Uzbekistan.

Representing an international pharmaceutical company in anti-monopoly proceedings initiated upon its application on suspicion of an act of unfair competition by a Russian generics manufacturer. The project involved communication with competent regulators (Russian Ministry of Health, Federal Anti-monopoly Service of Russia) as well as with industry business associations.

These series of cases and subsequent litigation had great resonance in the pharmaceutical industry and helped to significantly reverse the negative trend of generics companies appropriating the know-how and intellectual property of «big pharma» representatives.
International Commercial Arbitration

Representing the Republic of Belarus in investment treaty claims commenced by Grand Express under the ICSID Additional Facility Rules concerning insolvency of a railcar producing plant; and by Delta Belarus Holding under the ICSID Rules concerning the revocation of Delta Bank’s license.

Representing one of the biggest reinsurance companies globally in insolvency proceedings in respect of Russian insurer.

Representing major aircraft leasing companies on repossession of aircraft from various Russian airlines and representing them in Russian courts in related disputes, including insolvency of Transaero.

Representing Uniastrum Bank in insolvency proceedings of two companies of Gamma, a Russian hotel operator.

Representing a Credit Europe Bank in insolvency proceedings of Art Aztek Ltd.

Representing a Bank of Cyprus in the enforcement of claims against its debtor, the Russian development company, LLC Michaniki Russia, and its guarantors, as well as enforcement of mortgage of land plots in the Moscow Region worth more than 2 billion rubles.

Dmitry has experience in handling commercial and corporate disputes, construction-related matters, and debt recovery projects.
