Sergey Sushkov Published an Article in the HSE Journal of International Law


At the end of February 2026, the HSE Journal of International Law published an article by Sergey Sushkov, PhD in Law, a lawyer in the dispute resolution practice, titled “Universalism and Effectiveness: How Do Two Fundamental Principles Shape States’ Extraterritorial Human Rights Obligations?”


In the article, Sergey argues that the practice of international human rights bodies is shaped not by the texts of international treaties, but by the effort to strike a balance between two ideas. The first is the principle of universalism, which assumes that the protection of human rights should not be limited to a state’s territory. The second is the principle of effectiveness, which calls for avoiding unrealistic demands on states. This perspective on international human rights law makes it possible to identify the value-based and political-legal foundations of judicial decisions and to more accurately predict the future development of case law.
