DGP Junior Associate Published an Article in the “HSE Journal of International Law”

The July 2026 issue of the HSE Journal of International Law has been published, featuring an article by Timur Tkhamokov, DGP's Junior Associate in the Dispute Resolution Practice, titled "Appellate Review in International Arbitration."

The article examines the concept of appellate review in international arbitration. It argues that the traditional reluctance to permit merits-based review of arbitral awards is largely rooted in historical considerations that have lost much of their force today. Against this backdrop, the ongoing active discussions within UNCITRAL Working Group III concerning the possible establishment of permanent first-instance and appellate international investment courts are even more relevant. Timur concludes that appellate mechanisms may serve the needs of certain users of international arbitration without undermining its principal advantages in the modern context. However, it is suggested that such mechanisms should be available only on an opt-in basis by the parties’ agreement, require leave to appeal, be administered by a dedicated panel of appellate arbitrators, and operate under an expedited procedure. This approach may potentially improve the quality of arbitral decision-making, strengthen parties' positions in enforcement and annulment proceedings, and encourage voluntary compliance with arbitral awards.
