Matvey Tarasov published an article in the “HSE Journal of International Law.”

In late February 2026, the HSE Journal of International Law published an article by Matvey Tarasov, PhD in Law, a lawyer in the dispute resolution practice, titled “Counterclaims in Investment Arbitration: Prospects and Limitations.”


The article examines the mechanism of a state’s counterclaim against an investor in investment arbitration. Matvey notes that arbitral tribunals’ approaches to admitting counterclaims vary, but a trend toward a more permissive approach is emerging. In particular, drafts prepared by UNCITRAL Working Group III expressly provide for the possibility of counterclaims. At the same time, the range of claims that states may bring against investors remains limited, since bilateral investment treaties rarely impose obligations on investors. This significantly limits the prospects of states succeeding with counterclaims.
