Head of DGP IP & Tech Practice Participated in ICC Russia Meeting

Maria Samartseva, Counsel and Head of the Intellectual Property and Technology Practice at Dyakin, Gortsunyan & Partners, took part in an open meeting titled “Platform Economy: Issues of Liability, Counterfeiting, and Ineffective Enforcement Against Mass Violations,” attended by representatives of major platform businesses and marketplaces.
The event was organized by the ICC Russia Intellectual Property Commission to discuss issues related both to the development of the platform economy and its growing challenges, as well as the legal regulation of digital platforms and marketplaces.

Particular attention was paid to the legal challenges of the platform economy — a rapidly evolving model of the digital market where the risks of counterfeiting and widespread infringement are increasing, while traditional enforcement mechanisms lose effectiveness as violations scale up. Participants discussed issues of liability, ineffective enforcement, and possible approaches to protecting intellectual property rights under new digital conditions.

A separate point on the agenda was the growing misuse of IP rights in the online environment, including the rise of counterfeiting, parallel imports, patent trolling, consumer extremism, and the inefficiency of traditional countermeasures. Possible solutions to these challenges were considered, taking into account existing judicial practice in Russia and abroad.

“The platform economy is shaping new vectors for the development of intellectual property law. In today’s environment, the priority is to develop balanced legal solutions that can simultaneously stimulate innovation and effectively curb abuses in the digital space, especially amid the constant multiplication of infringements. The key task at this stage is to analyze the complexities associated with the operation of digital platforms and marketplaces, to seek a balance of interests among all stakeholders, and to develop recommendations that mitigate risks and ensure the protection of rights and interests of consumers, platform businesses, marketplaces, sellers, society, and the state,” commented Maria Samartseva.
