DGP Dispute resolution experts about LCIA practice on arbitrator challenges

DGP Dispute resolution experts — Partner Yan Kalish and Senior Associate Veronika Grubenko — in the February issue of the CIS Arbitration Forum online journal published an article on the London Court of International Arbitration (LCIA) practice on arbitrator challenges and how, against the backdrop of sanctions, this practice affects the strategy of parties from the CIS in arbitrations.

In the article, the authors address a topic that is usually discussed behind the scenes in arbitration: how arbitrators are actually challenged in the LCIA, on what grounds, and when a challenge is a strategically justified tool rather than a procedural gesture that increases the client’s costs.

The authors analysed LCIA decisions on challenges from 2017–2022 and identified the success criteria for challenge applications, the situations in which such applications are warranted, and recommendations for both parties and arbitrators. The conclusions also take into account the reform of English arbitration legislation (the Arbitration Act 2025) and its potential impact on practice.
